Resumo: Este trabalho defende a existência de direitos originários a prestações, auto-aplicáveis e diretamente retirados do texto constitucional sem intermediação legislativa infraconstitucional conforme o artigo 5º, parágrafo 1º da CF/88.

Abstract: This paper defends the existence of rights originating prestations, self-aplicable and directly taked from the constitutional text, in conformity with the 5th Article, in the 1st Paragraph of the Federal Constitution of 1988.
